LLP search comprises of choosing an exclusive LLP name, which is unique, not trademarked before, nor is registered with the MCA, prior to the LLP incorporation process.

To incorporated an LLP, various steps are taken out of which the LLP Name check is the elementary step.

To search and incorporate an LLP, the applicant must choose a name which is unique and not registered with the MCA portal. While choosing a suitable name for your LLP, make sure that:

  • The name should be not trademarked by any other applicant.
  • The should not be registered as any other entity with MCA.
  • Should not be a name of a registered business which is winded up not less than 2 years ago. In case of voluntary winding up & in case that business shut down by the influence of government then such a name will not be available for next 20 years.

Steps for LLP Search

There are two ways to search for an LLP name.

Way 1: A single window portal which provides LLP Search and aided incorporation solutions.

Way 2: A Government site, Name Search.

Way 1: Steps to Check LLP name and Register your LLP

Step 1: Visit Hire CA Limited Liability Partnership. And Enter your preferred name which you want to check and click on 'Go'

Step 1(a): If your name is not available. We show you all the trademark registered with the same name as well as the companies and LLPs' which are registered with the same name.

Step 1(b):  If your Name is available. Then you just need to add the product to the cart and click on checkout.

This is a precise platform, where there is no need for a separate search for Company data and Trademark data. There are way many trademarks which are registered and applied by individuals in their own capacity. So there is a high probability of the name selected to get matched with a Trademark already registered.

Way 1: Steps Check LLP name on MCA website

Step1: Visit Ministry of Corporate Affairs. Then go to 'MCA Services' and Select 'Check Company Name'. After clicking the 'Check Company Name' it will take you to another page.

Step 2:  You need to search every permutation and combination for the LLP name, to check its availability. 

The main difference in both the search portals is that, this website will only check the similarity with the registered names and do not check the names with similar trademarks, etc.  After entering a name. You might see 2 pages

Step 2(a)-: If you entered the name and search then, MCA will show the results of already registered LLP and Company names, indicating that the name is not available to use.

There is a Minor bug in the MCA website. Even if the company Name Status expressly mentions that the name is 'Available to Use', the same can be rejected by MCA. MCA might issue a notification for resubmission regarding the same, stating that it was already Trademarked by some other party or is subjected to some legal proceeding. MCA allows name as 'Available to Use'  when it does not match with any other registered name, but they have no provisions to reconcile the same with the Trademark data. 

Step 2(b):  If on entering a name, an Error is shown. It implies that according to MCA  the name is not similar to any existing registered company. But still MCA is not sure if such a name is available to use or not. Because they compare only companies and LLP data and not compare it with any Trademark data, etc.
