Documents for Trademark Registration

The most important documents for trademark registration as follows:

  • Soft copy of the trademark.

 In the case of an individual or an HUF

  • Identity proof and;
  • Business registration document (if available).

In the case of Company/LLP

  • Shops Establishment License;
  • Certificate of Incorporation and;
  • Address proof of the company.

In case of Partnership firm

  • The Partnership Deed.

Apart from these, there are no particular documents to be filed. Different forms for different types of applications have to be filed for registration of trademarks.

Applications to be registered for different trademark

1. TM-1:

For a specification of goods or services included in only one particular class.

2. TM-22:

For a textile trade mark (other than a certification trade mark or a collective mark) consisting only of numerals or letters or any combination thereof for a specification of goods or services included in one item of the Fifth Schedule under Rule 25(5) & 145.

3. TM-2:

For goods or services included in a class from a convention country under section 18(1) & 154(2)

4. TM-52:

Under section 18(2) for different classes of goods or services from a convention country under section 154(2)

5. TM-51:

Under section 18(2) the registration of a trade mark for different classes of goods or services.

6. TM-8:

Under Section 15, there are many or series of trademarks which come under the goods or services.

7. TM-37:

For a series of trade marks from a convention country under section 154(2) for a specification of goods or services included in a class or classes

8. TM-3:

Under section 63(1) to register a collective mark for a specification of goods or services included in a class

9. TM-4:

Under section 71(1) to register a certification trade mark for a specification of goods or services included in a class.

10. TM-45:

For a textile trade mark (other than a certification trade mark or a collective mark) consisting only of numerals or letters, or any combination thereof for a 2500.00 TM-45 specification of goods or services included in any one item of the Fifth Schedule under rule 145 from a convention country under section 154(2).

Trademark registration in India is valid for 10 years at a time and is renewable indefinitely. Documents for Trademark Registration is the most important thing required as the process is not at all complicated.
